Overview.

Welcome to Kkumi. In these Terms of Service (these "Terms"), "we", "us", and "our" mean Kkumi, and "you" means you, our customer. Kkumi operates this store and website, including all related infrormation, content, features, tools, products, and services (the "Services"). Kkumi is powered by Shopify.

These Terms, together with the policies we link to within them — including our Privacy Policy, Returns & Refunds Policy, Shipping Policy, and Additional Terms (covering the Kkumi Club, promotions, and gift cards and store credit) — form a single agreement that governs your use of the Services. Please read them carefully, as they include important information about your rights, our liability, and how issues are handled.

By visiting, interacting with, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

01Access & Account

1.1 Eligibility. By using the Services, you confirm that you are at least the age of majority in your state or territory of residence, or that you are using the Services with the involvement of a parent or guardian who agrees to these Terms.

1.2 Your Information. To use the Services — including browsing the store or buying products — you may need to give us information such as your name, email, billing, payment, and shipping details. You agree that the information you provide is accurate, current, and complete, and that you have the right to provide it.

1.3 Your Account. If you create an account, you are responsible for keeping your login details secure and for activity that occurs under your account. You may not sell, transfer, or share your account with anyone else.

02Our Products, Authenticity, & Gifts

2.1 Product Representation. We make every effort to display our products accurately. However, the colour, finish, and appearance of an item may differ from how it appears on your screen, depending on your device and its display settings. We do not warrant that a product's appearance will exactly match how it is shown in our online store. This does not affect your rights where an item is not as described (see Disclaimer of Warranties and the Australian Consumer Law).

2.2 Authenticity. Any official photocards or merchandise that we sell, or include with an order as a gift, are sourced from official albums or licensed distributors. We do not buy, sell, or trade fan-made or unofficial items (sometimes called "lomos").

2.3 Acceptable Minor Variations. Both official products and our own supplies may show minor variations that are a normal result of manufacturing and are not defects. For official products, this includes cutting "tabs" or "bump-outs," slight differences in thickness, and varied finishes between print runs. For our own supplies, this includes slight batch-to-batch differences in colour or finish and minor cosmetic surface marks. This clause describes only what is normal for the product type — it does not exclude a genuine defect, and nothing in it limits your rights where an item is faulty or not of acceptable quality under the Australian Consumer Law (see Disclaimer of Warranties).

2.4 Promotional Gifts. From time to time we may include a bonus item — such as an extra photocard, sticker, or other stationery — in an order. These items are gifts, included entirely at our discretion. They have no cash value, are not guaranteed to be included in any order, and are not part of the product you purchased. The absence of a gift is not a missing-item, shortage, or non-delivery claim, and is not grounds for a refund, replacement, credit, or other compensation. Because gifts are provided free of charge, they are not covered by our returns or Kkumi Guarantee process.

2.5 Changes & Availability. All product descriptions are subject to change at any time without notice at our discretion. We may discontinue any product at any time, and may limit the quantity of any product we supply to any person, region, or jurisdiction on a case-by-case basis.

03Orders & Verification

3.1 Placing an Order. When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted. We may decline or cancel any order at our discretion. Where we decline, change, or cancel an order, we will attempt to notify you using the email, billing, or phone details provided with the order.

3.2 Cancelling an Order. If you need to cancel an order, contact us as soon as possible at hello@kkumi.com.au. Because in-stock orders are dispatched quickly — often the same business day (see our Shipping Policy) — we cannot guarantee a cancellation, but we will accommodate cancellation requests where the order has not yet been dispatched. Once an order has been dispatched, it is treated as a return under our Returns & Refunds Policy. This does not affect any statutory cancellation rights you may have (see Complaints & Your Consumer Rights, and the Returns & Refunds Policy for EU and UK cancellation rights).

3.3 Personal Use & Wholesale. Unless you have entered into a separate written wholesale agreement with us, your purchases are for your own personal or household use and not for commercial resale. If you are interested in wholesale or B@B purchasing, contact us at hello@kkumi.com.au to discuss a separate arrangement.

3.4 Security & Order Verification. To protect the accuracy of your order and guard against fraud, we record video at our packing stations, capturing the condition and contents of items as they are packed (including, where relevant, the front and back of photocards or official merchandise). If there is a dispute about the contents of an order, this footage may be used to verify what was dispatched. We handle this footage in accordance with our Privacy Policy.

3.5 Returns & Exchanges. Your purchases are subject to return or exchange in accordance with our Returns & Refunds Policy and your rights under the Australian Consumer Law.

04Prices & Billing

4.1 Prices. Prices, discounts, and promotions are subject to change without notice. The price charged for a product is the price in effect when you place your order, as set out in your order confirmation email. Prices in our online store may differ from prices offered elsewhere.

4.2 Taxes. All prices are shown in Australian Dollars (AUD) and include any taxes we are required to charge. For international orders, prices and shipping charges shown at checkout do not include import duties, taxes, or customs handling fees imposed by the destination country; these are your responsibility and are delat with in our Shipping Policy.

4.3 Promotions. From time to time we may offer promotions governed by their own terms.Where a promotion's terms conflict with these Terms, the promotion's terms apply to that promotion.

4.4 Payment. Payments are handled by trusted third-party payment providers. You agree to provide current, complete, and accurate purchase and payment information, and to keep it up to date so that we can complete your transactions and contact you where needed.

4.5 Payment Authorisation. Where you pay by card, you represent and warrant that: (i) the card information you provide is true, correct, and complete; (ii) you are authorised to use the card; (iii) the charges will be honoured by your card issuer; and (iv) you will pay the charges you incur at the posted prices, including any shipping charges and applicable taxes.

05Shipping, Delivery, & Claims

5.1 Shipping Policy. Shipping, dispatch times, delivery estimates, and related matters are governed by our Shipping Policy, which forms part of these Terms. Please read it for full detail.

5.2 Delivery Estimates. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by matters outside our control, such as carrier handling or customs processing. Nothing in this clause limits any non-excludable right you have to delivery within a reasonable time under the Australian Consumer Law.

5.3 Risk. Risk of loss or damage to your order passes to you when the order is delivered to you or your nominated address. If an order is lost or damaged in transit before delivery, we will resolve it with a replacement or refund in accordance with our Shipping Policy and Returns & Refunds Policy.

5.4 Claims & Unboxing Video. To help us verify a claim about authenticity, transit damage, or a missing item, we recommend recording a continuous, unedited unboxing video from the sealed mailer. A video is not required, and not having one does not forfeit your rights — but it is the most reliable way to verify a claim. Claims are assessed in accordance with our Returns & Refunds Policy.

06Intellectual Property

The Services — including all trademarks, branding, text, graphics, images, product photography, reviews, video, and audio, and the way they are selected and arranged — are owned by Kkumi or its licensors and are protected by Australian and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, or transmit any material from the Services without or prior written consent, except as the Services normally allow (for example, sharing a product link).

"Kkumi", our logo, and our product names and designs are trademarks (™) of Kkumi. You must not use them without our prior written permission. "Shopify" and its branding are trademarks of Shopify. All other names and brands on the Services are the property of their respective owners.

07Optional Tools

We may give you access to third-party tools through the Services that we neither control nor monitor. These are provided "as is" and "as available", without warranties of any kind, and we are not liable for your use of them. Any use of optional third-party tools is at your own risk, and you should make sure you are familiar with and agree to the relevant third party's terms. Any new tools or features we add later are also covered by these Terms.

08Third-Party Links

The Services may contain links to websites or content operated by third parties. We do not control and are not responsible for the content, accuracy, or practices of those sites. If you leave the Services to visit them, you do so at your own risk, and we recommend reviewing their terms and privacy policies first. Any concerns about a third party's products or services should be directed to that third party.

09Relationship with Shopify

Kkumi is powered by Shopify, which provides the platform for the Services. Any purchase you make is made directly with Kkumi, not Shopify. You agree that Shopify is not responsible for any aspect of the sale between you and Kkumi, including any injury, loss, or damage resulting from products or services purchased, and you release Shopify and its affiliates from any claims arising out of your purchases and transactions with Kkumi.

10Privacy

We handle your personal information in accordance with our Privacy Policy, which explains what we collect, how we use it, and the choices available to you. Because the Services are hosted by Shopify, some information is also processed by Shopify under its own privacy policy. By using these Services, you acknowledge our Privacy Policy.

11Feedback

If you send us ideas, suggestions, reviews, or other feedback ("Feedback"), you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, and display that Feedback in any medium for any purpose, including to operate, improve, and promote the Services. You confirm that you own or have the rights to the Feedback you provide, that you have disclosed any compensation or incentive you received in connection with it, and that it does not breach these Terms or infringe anyone's rights. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it, and we may remove Feedback we reasonably consider unlawful or objectionable. You are responsible for the Feedback you submit.

12Errors, Inaccuracies, & Omissions

Occasionally the Services may contain typographical errors, inaccuracies, or omissions — for example in product descriptions, pricing, promotions, or availability. We may correct any errors and update or change information at any time. If an error affects an order you have already placed — for example, a product was listed at the wrong price — we may cancel that order and refund you in full, and we will let you know if we do.

13Prohibited Uses

You may use the Services for lawful purposes only. You must not use the Services: (a) for any unlawful or harmful purpose; (b) to breach any applicable law or regulation; (c) to infringe our intellectual property or that of anyone else; (d) to harass, abuse, threaten, defame, or harm our team or any other person; (e) to transmit false or misleading information; (f) to upload viruses or other malicious code; (g) to send spam or unsolicited advertising; (h) to impersonate any person or entity; (i) to collect or track the personal information of others; (j) to scrape, crawl, or harvest data from the Services; or (k) to interfere with or circumvent the security of the Services. We may suspend or terminate access for a breach of this Section (see Termination).

14Termination

14.1 Suspension or termination by us. We may suspend or close your account or your access to the Services where: (a) you breach these Terms or our policies; (b) you misuse the Services; (c) you engage in abusive, threatening, or harassing conduct toward our team or others; (d) we suspect fraudulent or unlawful activity; or (e) it is reasonably necessary to protect the Services, our other customers, or to comply with the law. We will give you notice where practicable.

14.2 Effect of termination. Termination does not affect any order we have already accepted, which remains governed by these Terms and your statutory rights. You remain liable for any amounts due up to the date of termination.

14.3 Survival. The following sections continue to apply after any termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver & Entire Agreement, Assignment, Governing Law, Complains & Your Consumer Rights, Privacy, and any other provisions that by their nature should survive.

15Disclaimer of Warranties

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these Terms excludes, restricts, or modifies those guarantees or any other rights you have under Australian law that cannot be lawfully excluded.

Subject to that, and to the fullest extent permitted by law, the Services and all products offered through them are provided "as is" and "as available", without warranties or conditions of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that information made available through the Services is accurate, complete, or useful. Any reliance you place on that information is at your own risk.

16Limitation of Liability

16.1 Consumer guarantees come first. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, r remedy you have under the Australian Consumer Law or other law that cannot be lawfully excluded. Where your statutory rights give you more than these Terms or the Kkumi Guarantee, your statutory rights apply.

16.2 Where liability may be limited. Where we are liable for a failure to comply with a consumer guarantee that the law allows us to limit (that is, the goods are not of a kind ordinarily acquired for personal, domestic, or household use), our liability is limited, at our option, to: (a) replacing the goods or supplying equivalent goods; (b) repairing the goods; (c) paying the cost of replacing the goods or acquiring equivalent goods; or (d) paying the cost of having the goods repaired.

16.3 General limitation. Subject to clause 16.1, and to the fullest extent permitted by law, neither we nor our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors (nor those of Shopify) are liable for any indirect, incidental, special, punitive, or consequential loss, or for any loss of profits, revenue, savings, or data, arising from or relating to your use of the Services or any product, however that liability arises.

16.4 Cap on liability. Subject to clause 16.1, and to the fullest extent permitted by law, our total liability to you for any claim arising from or relating to an order is limited to the amount you paid for the relevant order.

16.5 The Kkumi Guarantee. The Kkumi Guarantee (set out in our Refunds & Returns Policy) is a voluntary promise we make in addition to your statutory rights. It does not replace or reduce those rights, and nothing in this Section reduces any remedy we offer under the Guarantee.

17Indemnification

You agree to indemnify and hold harmless Kkumi and our affiliates, officers, directors, employees, and agents (and, where applicable, Shopify) from any losses, damages, liabilities, or reasonable costs arising out of: (a) your breach of these Terms or any policy incorporated into them; (b) your violation of any law or the rights of a third party; or (c) content you submit to the Services. This obligation does not apply to the extent the loss was caused by our own act or omission, and nothing in this Section requires you to indemnify us for any liability that cannot lawfully be shifted to you. Nothing in this Section limits your rights under the Australian Consumer Law.

18Reservation of Rights & Remedies

Suspension or termination is not our only remedy. If you breach these Terms, we may also pursue any other remedy available to us at law — including seeking an injunction or recovering damages — and may report unlawful conduct to the relevant authorities. Our rights and remedies under these Terms are in addition to, and do not limit, any rights or remedies we have at law, and may be exercised together or separately.

19Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full effect.

20Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding your use of the Services, and replace any earlier agreements, communications, or proposals between us on that subject.

21Assignment

We may assign or transfer these Terms, and our rights and obligations under them, including in connection with a sale, merger, or restructure of our business. Any assignment will not reduce your rights under these Terms or the Australian Consumer Law. You may not assign or transfer these Terms or your account without our prior written consent.

22Governing Law

These Terms are governed by the laws of Western Australia, Australia, and you and Kkumi submit to the courts of Western Australia. If you are a consumer who resides elsewhere, nothing in this Section deprives you of the protection of any mandatory consumer laws of the country in which you live.

23Complaints & Your Consumer Rights

22.1 Raising a complaint. If something isn't right, please contact us first at hello@kkumi.com.au. We take complaints seriously and will work with you to resolve them fairly and as quickly as we can. Product issues, returns, and refunds are handled under our Returns & Refunds Policy.

22.2 Australia. Our goods come with guarantees that cannot be excluded under the Australia Consumer Law (ACL). If we are unable to resolve a concern with you directly, you can also seek advice or assistance from the Australian Competition and Consumer Commission (ACCC) at accc.gov.au, or from Consumer Protection in Western Australia at consumerprotection.wa.gov.au.

22.3 EU & UK. If your order ships to the EU or UK, you also have statutory rights, including the cancellation rights set out in our Returns & Refunds Policy. If we are unable to resolve a concern with you directly, you can contact the consumer protection authority or alternative dispute resolution (ADR) body in your country — for example, EU customers can find a national dispute-resolution body through the European Commission's consumer redress information, and UK customers can contact Citizens Advice or their local Trading Standards.

24Changes to These Terms

We may update or change these Terms from time to time. The most current version is always available on this page, as well as the "Last updated" date. Changes apply from the date they are posted and only going forward — any order you have already placed is governed by the version of these Terms in effect when you placed it. Where the law requires us to notify you of a change, we will do so. By continuing to use the Services after changes are posted, you accept the updated Terms.
