16.1 Consumer guarantees come first. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, r remedy you have under the Australian Consumer Law or other law that cannot be lawfully excluded. Where your statutory rights give you more than these Terms or the Kkumi Guarantee, your statutory rights apply.
16.2 Where liability may be limited. Where we are liable for a failure to comply with a consumer guarantee that the law allows us to limit (that is, the goods are not of a kind ordinarily acquired for personal, domestic, or household use), our liability is limited, at our option, to: (a) replacing the goods or supplying equivalent goods; (b) repairing the goods; (c) paying the cost of replacing the goods or acquiring equivalent goods; or (d) paying the cost of having the goods repaired.
16.3 General limitation. Subject to clause 16.1, and to the fullest extent permitted by law, neither we nor our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors (nor those of Shopify) are liable for any indirect, incidental, special, punitive, or consequential loss, or for any loss of profits, revenue, savings, or data, arising from or relating to your use of the Services or any product, however that liability arises.
16.4 Cap on liability. Subject to clause 16.1, and to the fullest extent permitted by law, our total liability to you for any claim arising from or relating to an order is limited to the amount you paid for the relevant order.
16.5 The Kkumi Guarantee. The Kkumi Guarantee (set out in our Refunds & Returns Policy) is a voluntary promise we make in addition to your statutory rights. It does not replace or reduce those rights, and nothing in this Section reduces any remedy we offer under the Guarantee.
